Acceptance of our Terms and Conditions
These Terms and Conditions (“Terms”) govern your access and use of all of the services made available to you by or through Tilda Research, Inc. (“Tilda”, “we”, “us”), including without limitation through any and all designated web sites (“Sites”) or services, whether on the Internet or in person, owned and operated by or through us, and including without limitation in our participant recruitment and recruitment events, research and other services, referred to collectively as “Services” in this document.

Modification of these Terms and Tilda’s Sites and Services
Tilda may change or modify these Terms from time-to-time without notice other than posting the amended Terms on the Sites. The amended Terms will automatically be effective when posted on our Sites. Your continued use of our Sites and Services after any changes in these Terms shall constitute your consent to such changes.
Tilda reserves the right to change, modify or discontinue, temporarily or permanently, (any portion thereof) the Sites and Services, including any and all content, at any time without notice. You agree that Tilda shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Sites and Services.
Age Restrictions and Access Authorization
By using our Sites and Services, you represent that you are at least 18 years of age and not barred from using our Sites and Services under applicable laws and regulations. Accordingly, you also agree that you are fully able and competent to enter into the terms and conditions set forth in these Terms.
Intellectual Property Rights
The Sites and Services, and all materials they contain or link to, include registered and unregistered trademarks that belong to Tilda. Other trademarks, names and logos are the property of their respective owners.
Where Tilda’s Sites and Services offer the option to download particular material or documents, you may download one copy of the material or document for its intended use and purpose related to Tilda’s Sites and Services, provided that you keep intact all copyright, make no modifications to the material or content, and do not use the material or documents outside of their intended use and purpose in a manner that suggests an association with any of Tilda’s Sites and Services. Any submission made through any Sites and Services shall become the property of Tilda Research.
If you feel that any portion of our Sites and Services are violating the Digital Millennium Copyright Act (“DMCA”), please contact us (see “How to Contact Us” section).
Consent to Communications and Electronic Communications
By using the Sites and Services, you hereby agree to receive communications (“Communications”) from Tilda via phone, email, or text (“SMS”) regarding the Sites and Services.
These Communications may include notices and documents about upcoming appointments and appointment reminders, documents relevant to our Sites and Services, relevant and appropriate marketing materials, among others.
These Communications are part of your relationship with us. You agree that any notices, agreements, disclosures, or other communications that we send you electronically will satisfy any legal-communication requirements, including the requirement that communications be in writing. Message and data rates may apply to texts.
You may choose to stop receiving Communications from Tilda:
- For text messages by replying “STOP” to any text message you receive.
- For phone calls by referring to the “How to Contact Us” section and providing sufficient information for Tilda to properly process your request.
- For new research Communications as a whole, you may opt-out by opting out of receiving text messages and/or emails, which may impact your ability to continue participation in Tilda’s Services.
Please be aware that if you choose to stop receiving certain marketing Communications, you may still receive certain important non-marketing messages related to your appointments or about your participation in Tilda’s Services.
Tilda does not use emails for marketing purposes at this time.
Enforcement of Terms and Conditions and Acceptable Use
We reserve the right but do not assume the obligation to strictly enforce these Terms. You are prohibited from violating or attempting to violate any of Tilda’s Sites and Services security, including, without limitation, accessing data you are not authorized to access or attempting to breach or tamper with any Sites or Services.
However, we have the right to enforce these Terms and monitor our Sites and Services for the purpose of operating Tilda Research’s activities, to ensure compliance with our Terms, and to comply with applicable law or other legal requirements. Violations of these Terms or any of our Sites and Services’s security may result in disclosing unlawful conduct to law enforcement authorities, and pursuant to valid legal process, Tilda may cooperate with law enforcement authorities to prosecute users who violate the law.
Tilda and the Health Insurance Portability and Accountability Act
Unless Tilda provides written consent or signs a contract with a Covered Entity or a Business Associate as defined under HIPAA, we do not intend to create obligations under HIPAA, and make no representations or warranties that we do so.
Disclaimer of Warranties
Unless required by applicable law or agreed to in writing, the Sites and Services are provided on an “as is” basis, without warranties or conditions of any kind, either express or implied, including, without limitation, any warranties or conditions of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE. You are solely responsible for determining the appropriateness of using or redistributing the Sites and Services and assume any risks associated with your exercise of permissions under these Terms.
Limitation of Liability
To the extent permitted by law and applicable regulations, in no event shall Tilda Research, its employees, directors and officers, consultants or suppliers be liable to you for any direct, indirect, incidental, special, exemplary, punitive, consequential damages, or any other loss or damage of any kind, arising out of your use of the Sites and Services, including but not limited to, loss of data, however arising, even if Tilda was made aware of such a possibility prior to such damage.
